I didn't bookmark the link, but there was a relatively recent ruling in New York to cover cases like this. (You stumbled into the wrong thread at 4chan, viruses downloaded stuff, etc.)

Well, let's hope you live in New York, then. Still, I wouldn't take the chance.

(Anonymous) 2012-08-24 11:22 pm (UTC)(link)
What I'm saying is that there is now precedent.

If I accidentally see child porn I'm going to report it, and it bothers me that you're trying to scare people into not doing it.

(Anonymous) 2012-08-24 11:26 pm (UTC)(link)
Good lord, this. Don't report illegal shit that's hurting real people or BAD THINGS MIGHT HAPPEN TO YOU kinda makes me side-eye this person a little, ngl.

Except [personal profile] visp said to report it, just to be careful in doing so. So you know, you lose.

"If you have to report it, create an entirely new email address, using a public computer that can't be traced to you, and never access that account again."

That seems terribly impractical and not particularly encouraging of reporting.

Come on, Harry! :(

Go to a library/internet cafe. Create a yahoo email address. Delete yahoo email address.

Some people are paranoid, and won't report things for fear of incriminating themselves. [personal profile] visp's comment sounds like a pretty fair solution for such people. Anyone not concerned with such things may use their home computer, if they choose to do so.

Man people really like to read stuff into your comments that isn't there on this comm, don't they

So a comment that basically say "report child porn, but be careful about it" is interpreted as "don't report child porn"

F!S is ridiculous

this. I don't always agree with [personal profile] visp, but I did this time (on both points).

Sometimes I think they're just trolling, because I find it hard to believe that anyone could be that intentionally dense. Other times I just weep for the state of our schools, that such utter fail re: reading comprehension could have existed.

Sometimes doing something is impractical -- but it's worth being done, anyway.

(Anonymous) 2012-08-26 12:03 am (UTC)(link)
You people don't have Crimestoppers in the US?

(Anonymous) 2012-08-26 12:13 am (UTC)(link)
Anonymous tip-line. Nation-wide. If you're reeeeeeaaaalllly paranoid you can report from a payphone.
yeranonnyharry: (Default)

[personal profile] yeranonnyharry 2012-08-26 12:14 am (UTC)(link)
I suppose. Most people don't tend to think of using phones for voice calls these days. There is a form on the website for reporting - which requires a computer. Also, I can't remember the last time I found a working payphone.

...not to mention it's easier to type a web address than give it verbally...

Cell-phone with call-blocking then? Not that I want to enable OP, if they were actually looking at CP, they should get the book thrown at them.....

Precedent in one state in America, and that's just an interpretation of the current statute, which the legislature could decide to change at any time. And just because the circumstances in one case ended up that way, doesn't mean a person couldn't be charged another way. If you recall, I did suggest a safer way to report something, but go ahead and be bothered by the mean lady ruining your righteous idealism with pesky facts.

(Anonymous) 2012-08-24 11:45 pm (UTC)(link)
Sure, and you keep being needlessly pessimist and jumping to take everything personally in your every comment when people disagree with you.

Looking at your track record in this community, I don't know why I was surprised.

'Be careful you don't end up as a registered sex offender prosecuted for possession of child porn because that's a real risk" = "needlessly pessimistic?"

Oookaaaay... you just... go ahead with your special brand of optimism, them. Good luck with that.

[personal profile] kallanda_lee 2012-08-24 11:51 pm (UTC)(link)
But...her way isn't like super-complicated.

If you feel morally obliged to report something, then surely, 15 minutes of time at a cyber café with a fake address is not too much of an inconvenience.
andthenithappened: (Default)

[personal profile] andthenithappened 2012-08-25 01:35 am (UTC)(link)
They're not being needlessly pessimistic. They're being realistic.

Report shit that should be reported, but protect yourself when you do so. Seems sensible to me.

(Anonymous) 2012-08-25 02:47 am (UTC)(link)
Regardless of their track record, visp has a pretty good understanding of how hard the average US state cracks down on child pornography and what is and isn't a binding precedent. If you want to take the moral high ground, you should be aware that there are certain risks and that a ruling in New York does not in any way keep you out of jail in, say, Oregon.

(Anonymous) 2012-08-25 02:44 am (UTC)(link)
That's not actually a binding precedent (what you mean by precedent- a ruling that sets a standard for future rulings) outside of New York, any more than a ruling in Canada is a binding precedent in the US. A binding precedent has to be within the same jurisdiction to be anything more than a persuasive precedent (a possible sway to the judge). Only federal rulings can be a binding precedent to all US states.

So, visp is actually being smart. It's much easier to be careful than to try to convince a judge that you were not looking at child pornography on purpose and that a New York ruling should totally apply to your non-New York case.
