what's the problem with implying one religion is superior? i get that it's an asshole thing to do but why should the courts be dictating whether or not something should be allowed based on how "nice" it is? there are far worse things people are implying or outright stating that are entirely protected by law.

... Because the government/courts have absolutely no place to be putting value judgements on various religions? Separation of church and state?

You'd have to take that one up with the Constitutional Convention of 1787 and, like, John Marshall as to why it's the Court's job to dictate whether something should be allowed based on its constitutionality.

Incidentally, in the words of Supreme Court Justice David Souter: "government should not prefer one religion to another, or religion to irreligion." (Board of Education of Kiryas Joel Village School District v. Grumet, 1994).
