This is despite Florida's Stand Your Ground law, which states that force may be met with force, even deadly force, if one feels that they are threatened.

I was going to say, but didn't that one person shoot a black kid dead and is running free because of the "I felt threatened and stood my ground" thing.


But if it's a black woman using it to scare off her (male) attacker it's suddenly Not OK.

It's a whole lot of issues converging. First, her ex-husband's word is being taken over hers: he claims she aimed at him but looked away as she fired, she says she fired at the wall to scare him off and never intended to harm him. Second, she ran out to her car to get her gun, went back inside, and ended up firing the warning shot; because it wasn't her residence at the time (it was her former home and she was getting the rest of her stuff), the judge decided that she could have simply driven off instead of going back inside, so he won't let her invoke Stand Your Ground. Third, Florida has a 10-20-life law of minimum sentences, and firing a gun in the process of a felony lands her with a 20-year minimum sentence. And fourth, because she believes she hasn't committed a felony, she didn't take the plea-bargain, which would have reduced her sentence.

And now we have a black woman in jail for 20 years just because she was trying to get her ex-husband away from her so she could pack up the rest of her shit and leave for good.

OK, this seems to be the problem. I'm not American, but due to this part she could never claim self-defense in my country either. After she run out to the car, she was no longer in immediate danger and could have left or called the police to help her get her things. And if her ex had followed outside to threaten her, then shooting would have been defending herself. Going back to the house with a weapon turned her into an assailant.

She clearly wasn't thinking straight at the moment, and the sentence looks like an overkill, but she can't claim to have been only a victim here.
