Well, the difference is that Tolkien purposefully went for more or less complex messages. JKR probably has to say a thing or two against racism, but there's nothing biggger than that in her books. And this is not bad; in itself the fact does not make her worse than Tolkien (although I would say that he's better in regard to writing technique), it's just the way things are.

The hatred of some wizards for muggles is barely veiled metaphor for racism. Or xenophobia in general.

He's not a deity, but he had a very extensive and cohesive backstory to his world. More than was needed, really, but face it, he's the standard for creating your alternate fantasy/sci-fi world.

This. I love Harry Potter; I love Lord of the Rings. (Actually, I hate the book series of Lord of the Rings, but I love Middle Earth and everything to do with it.) Tolkien is not the fucking be-all end-all of fantasy.
