Re: Kindle Worlds
(Anonymous) 2013-05-23 04:06 am (UTC)(link)"Give up all rights to everything i write, forever? Hell fucking no."
That's not what the agreement said. You'd be giving your rights for the specific work away, and that's shitty enough really.
"... and hello - this is still pretty damn grey area..."
No, it's not. Not where Kindle Worlds is concerned, because it's being done with the permission of the license holder, for a very, very limited number of fandoms. They're not on board with publishing and making money off every fandom under the sun. THAT wouldn't be legal.
"They don't seem to get that the reason '50 Shades' was a 'success' in the non-fandom world is because it *was not* fanfiction. It might have started that way, but the numbers were filed off and it was basically bad pro-fic. If it had been sold *as* fanfic? It would have sunk like a lead balloon."
Perhaps, but how many of the dozens and dozens of publicity stories about 50 Shades failed to mention the fact that it was fanfiction based on Twilight? Very few, because 1) that was a big marketing draw and 2) Twilight was a huge success and not riding on its coattails a little would be silly in terms of PR.
I'm not saying that the success of 50 Shades would've been the same if people hadn't made a considerable effort to market it to a mainstream, non-fandom crowd, but you can't discount the influence of it being fanfiction or pretend that the stink of fanfiction would've doomed it. Clearly it didn't.
Re: Kindle Worlds
I'm still wondering if it's legal at all, since the TOS says that the author has to be sure it's all legally okay (read that in another forum) and how does *that* work? Most fanfic authors don't have lawyers on speed dial.
I think saying it was fanfic might have titillated some people, but even though the media hammered at that aspect, I think the average reader didn't really care much one way or another. I think the media pumped that book up a lot more than any readership did, and maybe i'm in the wrong places online, but i don't see much about it anymore - it seems to have fizzled out.
