age of consent

(Anonymous) 2013-09-17 12:35 am (UTC)(link)
All the "But she/he is under 18! Don't mention sex in the same sentence! OMG!" comments (here and elsewhere) are getting to me. In large parts of the world, the age of consent is much lower, and that is okay! I'm not advocating marrying 8 year olds here, but what's the problem with two sixteen year olds getting each other off? Really?

Re: age of consent

There's no problem with two 16 year olds getting each other off. The problem is with older people getting it off with 16 year olds. That's what age of consent means to me, and I think that's what people are usually talking about in the kind of thing you're referring to.

Re: age of consent

Age of consent is to stop adults from having sex with teens/children, not to stop two teens the same age from having sex. :p

Re: age of consent

But the problem is that this can be used against, say, a 17 y.o. and a 16 y.o. Technically that's illegal in some places, and yet they could literally be a day apart in age. What if some irrational parent freaked out and called the cops on that 17 y.o. and had them charged with statutory rape and put on a sex offender's list? I've heard of that happening before (probably not common, but still), and it could really ruin someone's life.

Actually, California's laws are kind of messed up here, they don't have any of the near age exceptions some states have, so technically, two sixteen-year-olds having sex together could both be arrested for statutory rape.

Um, it's illegal probably nowhere except crazy countries for two sixteen year olds to have sex. Age of consent means that a forty year old doesn't get to have sex with that sixteen year old, though. And I'm okay with that.

tbh 18 is a very good age of consent, in terms of psychological (and physical) development.

The impression that I get from these debates, frankly, is that a lot of people think that age of consent means "the age when you can have sex", and a lot of other people think that age of consent means "the age when people of any age can have sex with you". And I don't want to make any assumptions, but it really feels like the former group is people from most of the world, and the latter group is mostly American.

Not saying either is right (although I'll admit that the first version is a bit more intuitive even though I'm American). Just seems like it's mostly a semantic argument between people who actually agree on pretty much everything else.

Does age of consent not mean "the age when adults can have sex with you" anywhere? I mean, I'm pretty sure that's the legal (and enforced) definition, and a lot of people just don't understand it because the phrase alone can be misleading.

Re: age of consent

I don't know. I don't really know about consent laws around the world.

I've just noticed that, in previous discussions about this, there seem to be a lot of people whose response to "The age of consent is 18" seems to be "Well, are you saying two 16 year olds can't have sex?" or something to that effect.

SA - see, for instance, the comment right below this one where someone says exactly this!

In the UK the age of consent is 16, but a underage boy can get charged with statutory rape for having sex with an underage girl even if he's younger than she is.

Re: age of consent

(Anonymous) 2013-09-17 08:58 pm (UTC)(link)
That's really fucked up.

I mean wow...what if an underage girl rapes an underage boy, then shows proof of it. That would mean a rape victim getting accused of raping their attacker.

Except that in most of the US the age of consent is lower than 18, I think 16 is the most common AoC in the states

I don't care what two 16 years old are doing with each other, but I do not want to be RPing adult things (or livestreaming adult art or whatever) and have one of my viewers be underage, hell no. Not only a bit squicky for me but can also get me in a fuck load of trouble if the wrong person sees it.

Also if you're a grown adult writing about teenagers getting it on (as opposed to teenagers writing about it) fuck yea I will sideeye you - the more the age disparity, the more i will side eye

I'm curious about your last sentence. One of my favorite movies has teens as protags and I was a teen when it came out. However I'm now in my mid-20s and I still write fic about them. I'll keep getting older while the characters, unless I age them up, will still be 17. I don't see the problem with that.

I also write in other fandoms (some of which also have teens)and may not always write fic for this particular one, but my point still stands. As long as I'm just writing about fictional characters and not out there trying to have sex with teenagers, why would you side-eye me?

Just something to think about:

One of my ships, I started shipping when I was 11 (younger than either participant).

I shipped them when I was a teenager.

Now I'm in my thirties. Guess what? I still ship them. Just because I grew up chronologically doesn't mean my interest in relationship dynamics has changed drastically. Why is it somehow magically more skeevy that a pairing I wrote smut for when I was a teen is a pairing that I still write smut for now that I'm not?

I have no interest in real teenagers having sex. They're children to me now, so it's more of a "yes, I know it happens, but notthinkingaboutitlalalala". But characters are fictional and therefore a sort of ageless to me.

Nothing wrong with two sixteen-year-olds having sex - in fact, even in states/countries where the age of consent is 18, I don't think two 16-year-olds having sex would be illegal (because which 16-year-old would be the criminal and which would be the victim?).

What's creepy is when it's a 16 year old and an older (more than a few years older) person.

It is not illegal. I know, in America, or at least in most states, there's usually a provision for that - usually something like, as long as they're within 2 years of each other, it's okay.

I got the impression it was more about adults sexualizing people under the age of consent. I don't think saying a 16 year old is hot means you'd have no reservations about fucking them, but it's one of those things you can't always tell in text format...

Just ignore internet concern trolls.
