Actually, it's not a bad example, as the KKK has been at the center of *multiple* freedom of speech cases heard by the SCOTUS. With the exception of "fighting words" that create an "imminent danger" of inciting lawlessness or violence, hate speech is protected. That's why the KKK is able to pass out pamphlets and have a US-based website and have rallies centered around their vile speakers. What they *can't* do is say, "Hey, there's a black guy over there, let's go beat him up". Even if the speaker isn't actually a party to an assault or riot or whatever he/she is inciting, they could be charged criminally with that. (See: Brandenburg v Ohio, Virginia v Black [which ruled that even burning a cross on a black family's lawn was protected, although it could be a violation of city codes for fires], National Socialist Party v Skokie)

This is also the reason the Westboro Baptist Church can have their protests at soldiers' funerals (as long as they don't violate certain city ordinances such as sticking to an approved protest place, which would apply to every protesting group, regardless of their purpose). (See: Snyder v Phelps)
