I didn't comment in this thread before, but I've argued that the pairing is not 'really' incest elsewhere way back in the day when the first movie had just come out.
That had nothing to do with the fact that I don't consider adopted family or patchwork families as real family, or that I was squicked by Thor & Loki being brothers and somehow tried to justify shipping them to myself. It's just that where I live, a sexual relationship between siblings is only considered to *be* incest if they are either fully related by blood or half siblings, hence my initial confusion about fandom's insistence to call it incest despite the 'lack' blood relation.

Which is to tl;dr say I've been a dick about this back in the day out of ignorance and I'm sorry!

Can I ask where you live? Because as far as I'm aware the foundation for adoption laws are based on leaving no legal difference between an adopted sibling and a biological sibling, so it would mean the incest laws couldn't use the words 'brother', 'sister' or sibling' without specifying 'biologically-related' which sounds uncommon.
