On the off chance that you aren't a troll, I hope you live in America. And get pulled over in Texas or any of our other fine states that have the death penalty.

I cannot stand people who don't realize that what they're driving is a goddam two-ton weapon.

It is stupidly dangerous and potentially lethal, but that doesn't mean that people who do it should be killed, and it isn't necessarily "libertarian" to say that they shouldn't be.

I'm really surprised that you're apparently so pro-death penalty. Executing people doesn't reduce crime; it just results in more dead people.

And I hope your nipples get burned off by the fiery prongs of SATAN N PALS. Because even in Texas, DWI doesn't carry the death penalty.

So to the two-ton weapon idea, though, I totally agree with you. How many carjackings could be averted if people remembered "I'm driving the goddamn DEATH MACHINE, lemme find the ACCELERATOR"?

That's called intoxication manslaughter, and it's a 2nd degree felony.

If you are intentionally or knowingly killing someone with a car, even while drunk, that would not be classified as a DWI. It would be murder, plain and simple. If the murder falls under one of the several capital murder qualifications, THEN they can be given the death penalty.

It's a matter of intent, and driving while intoxicated pretty much presumes you don't intend to kill someone.

It may be a 2nd degree felony, but if your family has enough money, you could still get off with probation and rehab in Texas.

Oh, I agree. As I told the anon below, Texas should not be held up as an example for how to deal with DWIs or intoxication manslaughter at all. I can think of 2 separate people in my mid-sized city that killed or seriously maimed someone while DWI and got very minimal sentences. Both then went on to kill others in subsequent crashes while DWI. One killed a pedestrian (a pregnant woman) and the other went the wrong way on a highway and killed 2 women in a head-on collision.

I still don't think those people should be put to death though. They should have gotten long prison sentences after the first crashes, and it's horrible that it took more death for that to happen.

Anyway, I mostly just commented because I don't want people thinking that Texas puts everyone to death. Lets not start spreading false information and all that.

Well thank you! Unfortunately I was assuming in this situation that when OP inevitably kills someone and is pulled over, hopefully it's in Texas. I don't go for trying and frying when there's no death involved.

Just a really long, nasty prison sentence. Because that DWI is intent to kill right there.

I know I'm wasting my breath, but like I said above, intoxication manslaughter is not a death penalty eligible offense. The law presumes that it is actually NOT an intent to kill if you are driving while intoxicated.

Stop presenting Texas as a example of how DWIs or intoxication manslaughters should be dealt with, because you clearly have no idea. Most of them don't even get a "long, nasty prison sentence".
