The thing about comics is that it's not particularly linear story telling. There is really no 'end'. Batman has been fighting the Joker for nearly 70 years. Sure, DC can have Batman execute the Joker, but as he's one of DC's most popular characters, he'd only be retconned back in a short matter of time. And DC would essentially be left with a Batman who is fundamentally changed as a character- actually, I'd say the fact that if Batman took it into his hands to execute someone it wouldn't just change Batman as a character, but superhero comics in general. (Yes, Batman has considered killing people before, but he's never actually done it. And Wonder Woman and Superman have also killed people, but only in very exceptional circumstances, and never as a premeditated thing). There should be a fantastical, moral element to comics, imo. It's not supposed to represent real life.
DC's problem is that they keep making the Joker do worse and worse crimes, and it keeps looking more ridiculous when Batman and Gotham City do nothing to permanently stop him.
