the legal route of "once you publish your fanfiction you surrender the rights to me, in case I write something similar."
That's NOT the legal route. He can SAY whatever he likes, of course, but there's no way any court would enforce that nonsense. Published fanfic, like all written works, belongs to the writer of that particular story. Some of the underlying elements may still belong to GRRM, but the fanfic will never be his.

I remembered reading that was the stance Terry Pratchett took, but it wasn't so much to own the fanfiction as to allow himself to read it in a way that wouldn't lead to problems in the eyes of lawyers (because the problem is that fanfic writers could predict something and then if he read it there would be a slither of a case should that fanfic writer sue). That's why I brought it up.

But I can't find the source of it so... *shrug* Unless someone else finds it all we have is my memory and that's not a citable source.

Terry Prachett is also misinformed. He can't just bestow someone else's copyright on himself. (And that he seems to think he can - and then blame lawyers for it - makes me feel very unfriendly.)

A writer can certainly write the same idea as a fanfic writer, no problem. It's when they "happen" to reproduce large chunks of the fanfic writer's text that they need to start worrying about a lawsuit. And rightfully so.

Do you have evidence that what I thought was true? I might be the only one misinformed here and Terry Prattchet's actual stance on fanfiction is one that fits better with the reality of the situation.

I can agree with that.

I can't find anything to suggest Pratchett said the bit about "once you publish your fanfiction you surrender the rights to me, in case I write something similar." That doesn't sound very sensible, and not like Pratchett. This is what I found, that IS sensible:

Basically he's fine with it as long as you don't put it where he's likely to read it, isn't for profit and isn't labeled as "official".

Nope! I simply went the route of "even if everything you say about Pratchett is true, it's still not the way that copyright works." It didn't occur to me that you might not be married to that idea of Pratchett. (And, although I like his work, I'm not a staunch defender of his virtue.)

Fortunately for both of us, the other anon looked it up!
