Like, there's a huge spectrum here. Are both partners drunk? Is it an established relationship where the parents have discussed it beforehand? There's hardly one kind of 'drunk sex' that you can make up a hard and fast rule for.

Pretty much. You can plan beforehand to have drunk sex. But if you get drunk without intending to have sex and then someone (especially someone sober) has sex with you then it's pretty much gotta be rape.

Yes. Someone who is inebriated is in no position to be making that type of decision. Taking advantage of someone who can barely walk is just extremely disgusting, IMO.

Drunk doesn't necessarily = barely able to walk.

And, full disclosure: I often have sex while drunk. I do not believe I'm being raped because 1) it's something I enjoy and consciously set out to do; and 2) it's with my long-term partner.

Are both people drunk? (and while drunk "consenting" to sex?)

If so, I can't see how it's rape.

I also see gray area if the partners are, you know, together and in a sexually healthy relationship, and have established in some form or other that drinking with sex is okay. In this case, I'd equate it to having sex to someone while asleep - it can be rape, but if it's kind of the norm for both partners, it isn't automatically rape.

I mean, there's some gray area. But obviously the situation of someone too drunk to consent being taken advantage of by a sober person still stands easily as rape.

At the risk of this getting hate again: not necessarily, in my book. If you're passed out drunk: yes. But if you just had a few? Nah. I don't believe you just lose agency after a few glasses of booze. I had what I consider to be completely consensual sex when drunk. If it is rape - well, then I'm both a rapist and a rape victim at this point.

Not necessarily, no. I'm not on the "can't consent if you're drunk" bandwagon.

HOWEVER.

If one person is way more sober than the other, and the drunken person is sloppy, then you start getting into a really gray area, even if sloppy person says the right words.

It certainly can be, but it's not automatically rape. For example, sometimes my girlfriend and I get drunk at home and end up sleeping together. There's now way I would consider this rape; we're both totally fine with the idea of having drunk sex together.

If a sober (or far less drunk) person has sex with someone who's too wasted to consent to anything, much less sex, or if someone intentionally plies someone with alcohol to lower their inhibitions because they know that person wouldn't say yes to them otherwise then I would consider that rape. If both parties are totally wasted and end up sleeping together then I think that's more of a grey area because neither of them could really give consent. Is it mutual rape? Does it cancel out? idk

I still want to know if two drunk people rape each other when they have sex. Just saw an article today about a guy who got expelled for rape even though he was just as shitfaced as the girl - yet she wasn't expelled. I'll have to see if I can find that link.

On a broader thought, I am sometimes exasperated about how to address rape as a crime. Of course rape is bad and should be punished, but there seems to be a lot of gray area in even defining rape, and it's a crime that's so difficult to prove with evidence. I hear on feminist boards outrage - and rightfully so - that a vast majority of people accused of rape don't face any punishment. But how can we convict someone of a crime without proof? How often is their proof of rape? I want to trust alleged victims of rape, of course, but if all we have is the victim's word, how can we proceed in a court of law?

Just like this drunk scenario. I feel like I could determine if it were rape or not if I was watching the scene via video or something, but that's not a reality. And some things just make it fuzzy, for example, what if both people were drunk?

If one sober person gets another person wasted to the point of blackout in order to take advantage of them sexually, then yes, I would consider that rape.

However two equally wasted people having sex where they both started groping each other and then ending up in bed together? No. I wouldn't consider that rape. A dumb mistake? Oh, yeah. Rape? No.

Too broad a question.

It's not a yes or no answer. There are so many variables that could completely change the outcome. Overall it comes down to an issue of consent and if people are of sound mind enough to actually give consent - and that is between those two people. "Drunk" can mean so many things to different people, some are able to consent and some aren't.

So yes it can be, no it's not always.

If one person is so drunk they're passed out, yes. Otherwise, no.

I don't understand why the law considers you responsible for your actions if you get into a car and drive while drunk, yet somehow if you're a woman you're absolved of all responsibility for decisions made about sex while you're drunk. It's a stupid double standard.

Either you're responsible for what you do while you're drunk or you aren't. You can't have it both ways.

I believe all rape requires at least one rapist. So: one person unable to consent, the other (or others) in full control of their facilities? Rape. Everyone drunk beyond the point of being able to consent? Probably not rape.

Depends on how drunk everyone is and how explicit consent is. My sexual encounters have almost exclusively happened while under the influence, and all the times they haven't have generally been awkward to awful. For me not a single one of these times has been anything close to non-consensual, on me or my (various) partner's behalf.

I can only speak for myself though.

This is not black-and-white. It's much more nuanced that this simple question suggests. This is my standing:

If anyone was too drunk to consent willingly and eagerly, then yes it is technically rape. It sucks, but I think it's true. Once upon a time, I had someone come into the centre where I work and say that he thought he unintentionally raped someone the night before -- and was right, and the girl was distraught. Now that doesn't mean he's a horrible person, but he made a massive mistake and at least he was trying to make up for it in some way.

If all parties are eager and willing, then it's not rape. If everyone knows what's going on, and are keen to proceed, you're golden. It sucks hard if someone changes their minds the next morning, but there's a huge difference between "Yes!" and "No."

hmmmmmm, depends. Like, if drunken consensual sex is a thing so that wouldn't be rape. If someone is unconscious and the other person crawls on them and has sex then, yeah that's rape.
