I think the answer to that is whether the omission is material enough to warrant that it would have affected consent.

Fibbing about your job - maybe not, especially if it's a one-night thing. But supposing it also leads to a breach of trust or another civil tort or criminal offence that compounds the sex-under-false-pretenses situation.

Then yeah, it starts to look like material omissions or falsifications that would lead to the reasonable assumption that consent was not given fully.

I think it's not just that she fibbed about her name - like say a girl called herself "Angie" when her real name is "Jamie" - she did so in a way to create the impression she had a certain life history that was fundamentally false.

In short, the omission or fabrication Emily committed was material enough to render Daniel's consent potentially invalid, initiator or no.
