I've seen those. I love my whump Loki fics.

The only thing I can think is that Fury kept information about how he was weaponizing alien technology from the Avengers until Tony discovered it, and is generally pro huge dangerous secret guns and fighting machine caches, even right in the middle of urban areas like under government buildings. That might lead people to believe he'd also condone torture since he's so gung ho about being ready to kill large numbers of people.

Oh, I love whump Loki as well - I don't even mind OOC-ness when it makes sense based on the plot, but some of those stories start with the OOC-ness when nothing has actually happened to the characters yet.

I think one of the reasons people think Fury would be down with torture is that he definitely seems like a very morally grey character and - at least in the MCU, as far as I know - has never really said he wouldn't condone torture if it was "for the greater good". So if the option isn't explicitly out of the question, it might just as well be possible.
