There are actually legal questions in regard to custody. They really shouldn't be able to arrest them, especially since they are often held without bail and without a hearing.

Mostly it boils down to these 19th century cases that called immigration a "plenary power" and said that the federal government can do what it wants. Various laws have been put into place since then, some more restrictive than others, and sometimes putting limits on that power.

But a lot of immigration law really boils down to keeping out as many people as possible. Even with things like asylum we've made it so restrictive and so difficult to get even for people who should get it. But basically the government does what it wants. And because immigration law is mostly for agencies to enforce, the court lets agencies define what the interpretation of the law is and restrict it even further than the actual text allows or the original intent was.

There are so many problems with our immigration law. And the thing is, it is really, really difficult to get here through the legal channels. The caps are ridiculously low for visas. And even legal permanent residents who are supposed to be safe can have their status revoked. It is honestly insane if you look at the immigration system in our country. It is completely and utterly broken (and not in the way that people who want to close the borders claim).

Why should people just be able to immigrate to another country whenever they want, though? There SHOULD be caps and laws in place or else everyone would move to the countries that they perceive to be the "best," which would a) make those countries no longer so great due to overpopulation, and b) have a major negative impact on the economies and the society of the countries that the people have emigrated from.

Just wanting to move to another country - any country - shouldn't be a good enough reason to be able to do it easily.
