zuko was never really bad in the way kylo was though. he wasn't genocidal.... as a matter of fact i pretty sure being against that is what got his father to banish him.

Kylo isn't genocidal either. Murderer, sure. On the side of a genocidal regime, yes. But he himself has not been shown to be genocidal himself (not saying he's a nice guy because nope, no way. But I hate genocidal being used incorrectly).

I think you're missing the point. If the characters and their dynamics were in fact identical, then there wouldn't be any need to criticize this phenomenon, because the people who wrote Zutara and Reylo interchangeably would just be writing it IC.

The criticism is that Zutara and Reylo should be written as completely different ships, but instead fans of the former have latched onto the latter and are reproducing all the same story beats and relationship dynamics and tropes in their fic.

(Disclaimer: I haven't watched A:TLA and I don't read fic for either of these ships, so I have no idea how valid the above criticism is. I'm just clarifying the AYRT's argument as written in this comment thread.)
