(Anonymous) 2017-09-25 05:10 am (UTC)(link)I think people misunderstand how trademarks work and think it means you somehow own the constituent elements of the mark, when that's not how it works at all. I can't give the exact test off the top of my head but essentially all a trademark means is other people can't use the same or a similar mark in the same or similar areas of trade in a way that's likely to mislead consumers.
For example, Cadbury has trademarked the colour purple in my country. This doesn't prevent others from using the colour purple, it just prevents others from using the colour purple in their chocolate/confectionary wrappers in a way that might lead consumers to mistakenly believe their product is made by Cadbury.
