I'm sure there us an actual definition. In regards to biscuits/cakes which I imagine would translate to the biscuit/cookie scenario, in regards to how they react when going stale? I'm sure someone could google it.
But as an Enligh lass I'd call cookies, cookies and biscuits biscuits. They're not the same thing. After all we have cookies here too...
