I hate that AO3 bans this. We should be allowed to get paid for our work. AO3, okay with racism and pedophilia: not okay with fair recompense for labor.

AO3 is supposed to defend our right to do this shit, that is what the donations for their lawyers are for. Copyright is bullshit and should be illegal. Everything should be public domain from the start.

They defend our rights within US law, which stipulates that it's only a right so long as you don't make money off of it. Copyright being bullshit is an ENTIRELY different conversation and AO3 is not gonna be fighting that fight. The lawyers are to defend the rights we already have, not to destroy the entirety of copyright. You want to make money off your fic? Go somewhere else, because AO3 will not defend you. They never said they would.

AO3 is choosing only to fight the battle it can definitely win ("fanfic continues to exist") over the battle it can only probably win ("fanfic commissions get confirmed as allowed"). It's their decision to do that. They're here for fandom, not IP revolution.

I agree with you that copyright is bullshit. I vehemently disagree that the AO3 is in any way obligated to fight that legal battle, and least of all for anyone who's making specious accusations against the only library that defended fanfic writing in the first place.

Pretty sure it's not the tag wrangler's fault if the author's judgement is as poor as that. I just scroll until I find people who can tag for what's important in their story. Would recommend, as a filtering technique, because someone who doesn't wrap their head around useful tagging probably hasn't understood the finer points of writing. And, as it's a huge archive, and I can generally find much better.

Would you say the same thing to the many fanartists who charge for commissions? Why is it OK for this to be normal for fanartists, but vile and evil for fan writers?

This whataboutism is fucking annoying.
1) Artists do not have archive. So it's on them to decide if they want to risk being sued or not. Usually they slip through the cracks because no one bothers.
2) Disney for example is known for suing or C&D-ing artists
3) Writters can take commissions on their own pages or tumblrs or patreons or whatever. It's not considered evil by majority

There are several things that make commissions different, to begin with. The buyer is paying the artist for the time and effort that they are spending to create a piece that's exactly to the buyer's specifications. Additionally, a commission is meant for the buyer's private enjoyment and most artists won't even post commissioned work on their webpage without the buyer's express permission, because the art is meant for the buyer and the buyer alone.

That's not at all the same as artists who draw something and then print off 100 prints of the image and sell those.

Agreed it's okay with racism and pedophilia. Disagree that people should be paid for writing fan fiction.
Why can't we have fun with fan fic? Why does capitalism have to brought into everything? I'm surprised people are fighting for everyone in the fandom community to be competing with each other for money, which everyone (unless they're already extremely rich) already are struggling with in their outside lives.

Fanfic already has enough ego and competition-related problems, all we need to add more monetization to the mix. Fuck that.

It's also important that it has a very low bar to entry for participation. Everybody with internet access can read or write fanfic, which means you can be low-income and still be fully included. If more of it starts to disappear behind paywalls that will just make fandom suck more for everyone.

If you want to make money off it, stick to old properties that are in the public domain. New versions of Dracula and Sherlock Holmes and the like are still popular and sell well.

This. All of this. This is my biggest reason for being against monetizing fanfic. The legal reasons are valid, too, of course, but yeah, this is the part that bothers me the most.

Not adulterating or deleting the stories is proof of the archive's integrity and courage. All the accusations I've come across against the AO3, from people who want content censorship, have been flimsy at best.

As a fanfic writer, though, I completely agree with you that profit-seeking has no place there.

I love that AO3 bans this. If you want to set up a shop, pay for it. I'm not sending money to a library so that greedy fucks can try to force a living out of the gift economy.

Also, I'm tired of people pretending they can't tell the difference between writing about a thing and making it happen. A fanfic about you winning a million dollars can't add a cent to your actual bank account, and a fanfic about adult/child abuses zero real children.

So don't whine about the AO3 and "pedophilia." And in a similar vein, I've yet to see any allegation of AO3 racism that isn't an absolutely dishonest farce.

Funny how sending actual child pornography as an intimidation tactic failed, and now there's a proliferation of specious accusations against the archive. Plus, you apparently think they should pick a fight with the American legal system over copyright law. And I'm over here like, "no, to all of the above."
