That's very much debatable, and it depends on your definition of personhood. To me, someone is only a person between being born and dying.

I can see that, some people do consider that the qualification.

Do you think of brain-dead individuals as a person? Technically, they're alive but have no thought processes and, since they're relying on machines to regulate their bodily functions, are essentially dead.

Surely you can agree the body is still a human (what other race does it belong to), thus giving the body the same rights, etc. as a living human.

nope. fucking a brain-dead body isn't rape either. It's akin to bestiality perhaps since it is a living thing (in the strictly biological sense) that is incapable of giving consent.

If you are braindead, well, again the person has left the building.

Oh God, no, absolutely fucking not. They are alive and they can't consent to sex, therefore it is rape; just because they can't comprehend it doesn't make it not rape, just like if you drug someone and they wake up with no idea it happened doesn't make it not rape.

It's still fucking sexually taking a living person's body without their consent.

Personally, no, I do not. But if interested, I specified why I would consider violating a braindead patient different from having sex with a corpse.

(Don't get me wrong, I consider it to be pretty vile and respectful to have sex with dead bodies, too.)

Yes, the body is human, but not a person anymore, and that does make all the difference in the world. The respect we have or corpses is usually linked with honoring the memory of the person they used to be, or their family's feelings. A body does not have the same rights as a person, otherwise we could keep corpses in our living room.

And separate from rights: you cannot hurt a corpse. You cannot psychologically traumatize it for life. You cannot make it pregnant. It's just...not the same at all.

But what if in the case where someone believed in an afterlife, specifically one where the body must be respected, and if it's defiled the soul will be at unrest?

I mean, from an atheist perspective it wouldn't be a big deal, but there are a lot of belief systems that view proper burial care and respect to be integral to the person's consciousness finding peace.

I am just going to say that I'm extremely thankful that you brought this up. Not many people here seem to have considered the existence of alternate cultural views on death/the afterlife/the body/consent/basically anything, and that's kind of irritating.

Well, one might argue that even if you believe in an afterlife, the "soul" is already gone.

I am not saying we should just happily cheer on necrophiliacs and not sanction them at all. We most definitely should.
What me and some others in this thread were saying is that violating a living human being (or even a living animal)is just completely on a different scale than defiling a corpse. Yes, perhaps you are indeed going against someone beliefs...but that is a completely different spectrum, and a different sort of crime.

I don't know. Compared to all the other things that typically happen to a body after death?
* being stripped, manhandled, and washed
* coated in makeup
* possibly dissected for forensic or medical reasons
* major organs, skin, and tissue removed for use in medical procedures
* bodily fluids drained and replaced with toxic agents
* the lower jaw stitched to the upper to keep it shut during funerals, (otherwise you get the howling zombie look)
* eyelids and lips glued shut
* buried or cremated
* alternatively dissolved in lye or dipped in liquid nitrogen, shattered, and freeze-dried.

So yeah, if we consider human remains to have human rights, that would prohibit a lot of what we do as part of burial. Thankfully, squeamishness about necrophilia doesn't demand that we give a corpse human rights. We can recognize that such extreme forms of posthumous disrespect are the mark of a sick fuck, or violate the sensibilities of the deceased's community.
