Um, no, it's more likely that a fan will write a story where like there is a cat, and then the author has a book where there is a cat, and the fan will sue because THEY STOLE MY IDEA.

this. she had them on over 6 percent of her body and required several skin grafts for them (which aren't cheap, hence part of the reason why she sued. she actually tried to settle at about 20,000 dollars but in a fit of idiocy McDonalds said no so they moved forward with the case and she got over 600 thousand bucks out of them)

I can understand they're not cheap, but unless she had the cup sitting in a secure cup holder (instead of holding it in her hand or between her knees while she was driving) and the cup just disintegrated and spilled all over her from there, then I can also see how McDonalds would think it might be possible for them to win the case.

Reading over the case now, I do think that she had likely cause to sue. However, I do dislike the suing culture that assumes the majority of the fault lies with McDonalds in this case (because there are other issues where McDonald's is ridiculous, and where they should be shouldering the blame). The client performed a couple of ill-advised actions herself (balancing the cup between her knees, which is a recipe for disaster in many times I have seen it done by other people and a couple times with myself), and other parts of it are tragedy of the circumstances. It was a terrible accident, and it's not like McDonalds (in this case) was doing anything other than serving coffee at a temperature that most it's clientele desired.

Urgh, defending McDonald's beyond a cheap joke... bleh. Excuse me while I go to wash out my mouth.

But as I said, she did have cause to sue as in her case I doubt she had the money to pay for those bills, and McDonald's should have offered her more right off the bat as they were partially at fault.

Of course, this is all from a moral discussion and less from a law one, as I'm not a lawyer or even a law student.

And, with all that said... I am kinda amused that you feel the need to accompany every post with a rude tone when I have yet to do the same to you. There is no need for being brash, especially when it comes to cultural situations like that it is rare that a person would know the extent of the lady's injuries. Heck, I think I was under ten when that case was passed. Heard the jokes, didn't even know it was a lady who sued or what their age was or what degree the burns were.

So I take a hot cup of coffee, balance it in my lap, and it spills, and in your opinion that somehow makes it the fault of the people who sold me the coffee? No, that's the fault of my own damn stupidity in putting the coffee there in the first place.

I feel for the woman and the severity of the injuries was clearly horrible but it was in no way anyone's fault but her own.

Except if she had consumed the coffee normally those burns would be on the inside of her mouth.

Wrong. I heard a story on NPR about the McDonalds coffee case some time back, and what you need to know is that McDonalds was serving their coffee at an excessively high temperature and had been receiving complaints about this for a while, and did nothing.

One of the reasons that case resulted in such a punitive payout is because there was a pattern of negligent behavior on the part of McDonalds. It wasn't just some one-off incident where no one else cared or suffered harms.

Dude, their coffee was so hot that if she had drank it, like one does with coffee, she would have gotten burns on the inside of her mouth that would be horrible.

And Mcdonalds was well aware their coffee was dangerusly hot, employees who had been injured because of it had brought it to their attention many times
