I think, given that Storybrooke is not a town recognized by the United States by way of magical shielding (no one could even see Storybrooke until the curse broke), Henry was already kidnapped. By Regina and Mr. Gold. I doubt that many US laws apply all to this place.

I see no logic in this. None at all. You could argue they can't operate within the usual child protective services, but Emma put Henry up for adoption. He wasn't kidnapped, at least not by Regina. I don't watch anymore so I don't know if Gold did anything hinky in the adoption, but Regina just adopted a kid.

Granted I don't know the details of how the adoption process works, but how would an adoption agency let a child go to a woman who essentially doesn't exist and lives in a town that isn't real?
