I don't like that they ignore the legalities in the situation because they interfere with the story. Taking Henry from Regina is legally kidnapping until Child's Services comes in and evaluates the situation (or however the specifics work out). Implying otherwise feels like its disregarding the fact that she's his mother. His only mother.

This. It's not that I feel Regina is a great person or a gtreat mother. But Emma is not Henry's mother. If CPS evaluated, I could see Snow and Charming getting custody, maybe (given the age discrepancies, it's complicated), but Emma forfited her rights and is not Henry's mother.

If CPS could intervene (which it really can't), other legal forces could as well, and Regina would be in jail for multiple counts of both attempted murder and conspiracy to commit murder, among other things.

Since I can't edit, let's list them here (this is only since she's been in Storybrooke, because of the mention of real-world legal stuff):

Actual murder:
1) Henry, since she intended to kill Emma and that intent would be transferred since he actually died (albeit temporarily, but it would have been permanently if Emma hadn't thought to kiss him)
2) Graham (no explanation needed)

Attempted murder:
1) Emma, with the apple turnover
2) Charming, before Henry interrupted her in 'Broken'
3) Snow, when she pulled her heart out of her chest (before she saw the black spot and put it back in, she intended to squeeze it to dust)

Conspiracy to commit murder:
1) Kathryn Nolan (Rumple may not have killed her, but that was what Regina thought they were plotting together)
2) Mary-Margaret, since either way Regina intended for her to cross the town line, which before the curse was broken would likely have ended in her death
3) Emma, again with the apple turnover, since she enlisted Jefferson's help
4) Emma, Snow, and Charming, in s2, with Cora
5) Technically, with Anton, since she gave him the means to go on a rampage and they both intended for him to kill Charming and anyone else who was in his way.

Felony murder:
1) Johanna - even though Cora killed her, Regina was a co-felon and so would also be guilty for her death.

I could be forgetting something, and of course her crimes in the Enchanted Forest are too numerous to list out. Anyway, even if CPS could enter Storybrooke, no way would it leave Henry with someone who'd committed that many crimes in the real world, adoption or no adoption. That is if she didn't roast them all alive first like she tried to do to Charming, Emma, and Neal - wait, is that another example of attempted murder?

I have no idea why you left that as a response to my comment. I said that Regina is not a great person nor a great mother. I'm not disputing that she has done a ton of things that are illegal/immoral/whathaveyou.

However, Emma is also not Henry's mother. She gave up her rights.

I'm perfectly fine with Snow and Charming getting custody. I am not with Emma getting custody.

I think, given that Storybrooke is not a town recognized by the United States by way of magical shielding (no one could even see Storybrooke until the curse broke), Henry was already kidnapped. By Regina and Mr. Gold. I doubt that many US laws apply all to this place.

I see no logic in this. None at all. You could argue they can't operate within the usual child protective services, but Emma put Henry up for adoption. He wasn't kidnapped, at least not by Regina. I don't watch anymore so I don't know if Gold did anything hinky in the adoption, but Regina just adopted a kid.

Granted I don't know the details of how the adoption process works, but how would an adoption agency let a child go to a woman who essentially doesn't exist and lives in a town that isn't real?

If the show were set in the 'real world,' I would agree with this. However, I feel like Storybrooke, being a magical town created by Regina, isn't subject to real-world laws. If it was, then the residents (and Regina in particular) would have much larger problems than which of his many family members Henry lives with. You can't subject one part of the story to modern law and not the rest of it.
