He sued to have all traces of his modeling shoot for XY erased from the internet because the images of men kissing each other are "pornographic" and he's sorry he agreed to that shoot and hopes it won't hurt his career that he modeled for, in his own words, "lewd photos." How is that NOT homophobic?

(Anonymous) 2014-03-11 11:10 pm (UTC)(link)
Well, were they pornographic or just kissy-kissy? Details plz.

(Anonymous) 2014-03-11 11:17 pm (UTC)(link)
SA

Nevermind, found the pics. Muy caliente.

Anyway, he didn't sue anyone - his reps evidently scoured the 'net and sent out a bunch of cease-and-desists.

Was that right? Probably not. It wasn't illegal for anyone to post the pics; they're public material.

Did it help his career? Maybe. His reps may have had experience with young unknowns in similar situations that had trouble making it in mainstream media.

Does it reflect his personal views? I don't know, and neither do you.

(Anonymous) 2014-03-11 11:20 pm (UTC)(link)
Great, now google the lawsuit instead of just the pictures. When you read it, you'll see he hired a rep to hire an attorney to sue to have the images removed and his reasons for doing (it's pornography when two men kiss, etc) are clearly stated and his signature accompanies the documents.

AYRT

It would be easier if you just gave me the source. My googling has only turned up threats to sue, no actual lawsuit.

Nevermind, it's been removed from all search engine results as part of the settlement. Their is a notice about it on the results pages.

Same thing all search engines.

The takedown request was made by the photographer...how do you know it was part of the settlement?

http://www.chillingeffects.org/notice.cgi?sID=75423

This is all I've been able to find, which is what leads me to believe there was no actual lawsuit:

Now for those unfamiliar with the controversy here it is, in his early years Colton posed for a photo-shoot in the now-defunct XY magazine. These pictures saw him kissing boys in a Jacuzzi and posing shirtless in a locker room, relatively tame stuff if you ask me. Well since Colton Haynesis now making it big on MTV’s new series Teen Wolf, the powers that be, seem to pulling out all the big guns with the purpose to “de-gay” his internet presence, by threatening to sue any blogger that runs pictures from the said shoot.

THEQIT.com is just one of the numerous blogs that has been hit with a threatening cease desist letter from Colton Haynes legal representative Bryan J. Freedman stating the pictures were “sordid, grossly perverted, and can only appeal to those with the most prurient of interests. That you would publicize such content is disturbing. Your election to continue doing so is criminal. The public disclosure of, and wrongful intrusion into one’s private activities, constitutes an invasion of privacy and is actionable in most jurisdictions, including California”

Because there was a lot posted at the time it was happening, including by legitimate news agencies. I know some blog owners have gotten cease and desist notices for having posted either the pictures or about the story, but it looks like the news agencies did too because Reuters and AP don't have anything on it anymore.

SA again.

Ooh, just found out he was also underage when the pics were taken. Umm. Yeah, kind of on Colton Hayes' side here.

(Anonymous) 2014-03-11 11:25 pm (UTC)(link)
Wait, were they porno or was it a model shoot with kissing? Underage porno = bad, underage models kissing = legal.

(Anonymous) 2014-03-11 11:31 pm (UTC)(link)
AYRT

Well, it was shirtless kissing with tongues involved and close bodily contact. I'm not entirely sure where the line is drawn.

But I kinda think if he wants somewhat questionable underage pics of him taken down, I can't really fault him. I don't know what he said in connection with it, but I'm trying to track down the source.

(Anonymous) 2014-03-11 11:37 pm (UTC)(link)
I don't about the line either. But if it was a professional model shoot and he got paid, can he say to have them taken down? Or could he even have agreed to do that modeling in the first place because I would think underage means he couldn't. It's all very strange.

(Anonymous) 2014-03-11 11:40 pm (UTC)(link)
AYRT

From further up in the thread, the DMCA takedown requests actually came from the photographer. So the photographer was either sued, served with a cease-and-desist letter, or was afraid of a suit. Maybe he didn't know at the time Colton was underage. It's all very murky.

[personal profile] glo_unit 2014-03-11 11:40 pm (UTC)(link)
Kissing, very suggestive kissing, but not pornographic. It isn't illegal but possibly understandable that once he got to a little older he wished he wouldn't have done the shoot.

(Anonymous) 2014-03-12 07:54 pm (UTC)(link)
DA

XY has a tendency to feature what is basically soft-core teenage pornography. Honestly I kinda side-eye that mag a bit.

(Anonymous) 2014-03-11 11:13 pm (UTC)(link)
Depends. Are there shoots of him making out with women that he's fine having available to the public? Because that's the only way being against those photos necessarily screams homophobia.

(Anonymous) 2014-03-11 11:17 pm (UTC)(link)
Yes, he's been photographed kissing women and didn't sue to have the images erased. He's also been filmed kissing women and has not sued to have the studios destroy the footage.

Even if that weren't the case, his homophobic comments about being photographed kissing another man are enough to demonstrate that he is homophobic.

(Anonymous) 2014-03-11 11:19 pm (UTC)(link)
his homophobic comments about being photographed kissing another man

Source?

[personal profile] glo_unit 2014-03-11 11:42 pm (UTC)(link)
Man, I had almost forgotten what a crazy mess that situation was, and still wish I knew what the hell went on.

(Anonymous) 2014-03-11 11:44 pm (UTC)(link)
What went on? The usual closet case antics.

[personal profile] glo_unit 2014-03-12 12:06 am (UTC)(link)
Actually no, it was odder than that. NOTE: most of this is my third person observations and memories from events a few years ago, and while I have a very good memory, I'm not going to pretend I will have things right.

One blogger posted the full cease-and-desist letter, and in addition with the part posted earlier was a section proclaiming that the pictures where meant to be private. However on a blog(possible the same blog), mentioned corresponding with either the former magazine editor or the photographer, and getting that shoot was completely legal and even Colton's mother signed a release for him to be able to do the shoot.

So while it did call the photos lewd and other names, it was oddly the closest thing to outing Colton that I know of. Muddying the waters somewhat is that while it was a shoot for the magazine XY I believe the magazine itself presented that pics and two cute models who happen to be dating sending it personal pics of themselves.

It reminds me of Luke Evans, both situations are complicated and odd, and no one knows much big if any part the actor played in their respective situations.

Anon who's been all over this thread (but there is more than one of us)

Thanks for that. It at least provides some color as to why the lawyer was saying the pictures were private. Not saying they were, just saying it's interesting that's how they were presented in the magazine.

(Anonymous) 2014-03-12 04:00 am (UTC)(link)
Ugh, Luke Evans. Meh.
