How would you unfuck copyright?

(Anonymous) 2018-09-23 08:27 pm (UTC)(link)
Bonus points: how would it change fandom?

What does this mean?

Re: How would you unfuck copyright?

(Anonymous) 2018-09-23 08:35 pm (UTC)(link)
There's a common argument made that copyright terms have gotten too long (especially in the United States) due to corporate interests (especially Disney) supporting extensions to maintain control over their intellectual property. The argument is that allowing companies to maintain copyrights effectively indefinitely impoverishes the public domain and the creative process.

Unfuck what about copyright? Are you angry that people make money off things you like and think therefore it should be given over to you?

- everything before some arbitrarily chosen date (probably around 1950, or somewhere within 5 years) immediately becomes public domain

- new copyright term is creator's lifetime + 50 years, or 50 years after publication for anonymous/pseudonymous/work-for-hire

How does that work for companies that create something? The lifespan of the company?

falls under "work-for-hire". 50 years after publication.

I'd actually say creator's life or 50 years when creator is unknown/company. I don't think you have to keep it copyrighted after the creator dies.

As a writer, I'm okay with this. It's no skin off my nose if my work becomes public domain after my death (stipulation of if it was a co-authored item, and my co-author is still alive, then that particular item remains copywritten until their death).

The argument is that it's something of value that you can leave to benefit your heirs.

Should be after the creator's death at the maxium. Money does them no good in death.

It does good for the people that they love and leave behind.

TBH I'd make it a REQUIREMENT to credit the creator when it comes to derivative works. If a derivative work is found to not credit the author print would be suspended until it was added.

That seems difficult to enforce.

Hmmm. True.

Perhaps there's publishing houses for specifically fan works and specifically original works?

Nice in theory, almost impossible to enforce in reality. At best, you'd wind up with people being forced to credit people whose work they've never so much as read a word of because of a similarity in concept or execution that occurred entirely by chance. At worst, you'd have wealthy creators - or more likely wealthy corporations that hold a copyright - throwing their weight around specifically to silence or delay other voices.

It only belongs to primary creators or people given contractual authority by primary creators. It's considered illegal for distributors to make more money than primary creators after making back resource and supply costs.

LOL, a girl can dream.

What does "primary creator" mean it terms of, say, a blockbuster movie? Where thousands and thousands of people contributed to its creation?

Directors, writers and designers.

-Derative works are legal to sell.
-Creator holds the copyright for 15 years, then it becomes public domain.

-Derative works are legal to sell.

What kind of control does the original copyright holder have over them? What kind of monetary payment does the original copyright holder get from them?

If the original copyright holder can't stop them from being made, and doesn't get paid for them, what does it mean for them to have the copyright in the first place?

Re: How would you unfuck copyright?

The original work is the author's alone. Stuff inspired by is fair game unless it's straight up plagiarism. Like West Side Story would be fine to make, but if only a few lines were changed from Romeo and Juliet's script, that'd be a no go. Fanart, fanfic, and the like would be safe to profit from, basically. Or anything that requires a fair amount of effort to create.

The copyright would protect the creator from people printing the book and reselling it without compensating the author, basically.

More professional than fandom:

1. Broader and clearer fair use, especially for education.

2. No copyright (or a different form of copyright) for works that receive government funding, and create gratis distribution channels for peer-reviewed research.
