If you're talented enough at what you do, be it writing or digital art, that you can make money off it, do so without giving the finger to the copyright gods. Make your fanstuff for free, and ask your audience to pay for original art, original fic, original whatever. Don't risk bringing down the copyright banhammer on everyone else just because you can't think of another way to make rent.

The foundation behind AO3 will always countersue the copyright holder on your behalf though, because royalties are wrong for original work.

If you're that popular, and your audience loves you that much, why not?

Unless, of course, it's solely the copyrighted material people are paying for. Which again brings us back to don't sell other people's copyrighted material no matter how 'easy' it is.

Uh, yeah, it is? If people like your art style, they'll be willing to pay for your original stuff. I just commissioned a picture of my D&D character from a fanartist I like because her style is exactly what I want for my character.

I was also just at a con, there was one artist in the artist's alley selling original 80s retro-style cityscape prints and by the time I left on Sunday, they'd sold out of almost all of their prints and only had a couple of styles left. There's clearly a market for nice original art out there.

How is a commission of a D&D character materially different from commissioning art of your Naruto OC, though? The vast majority of commissions that I've seen are of the client's OCs in a given fandom.

It's not just a matter of whether or not people like your style, its also a matter of getting your name out there in the first place.

The vast majority of artists I follow online is through their fanart of fandoms I'm in. Back when I used to post art on Instagram, the vast majority of my followers found me through my fanart. People like things that are familiar. Obviously it doesn't mean that people who only make OC stuff are doomed to be forever unpopular, but it takes alot more effort and time.

So I've never made money on fandom stuff, but this is horribly naive. And I say that as someone who actually managed to get a handful or original stories published. There are amazing, talented artists wo make nothing with original work, because you don't have the fanbase...let's be real, 9/10 no-one cares about OC's.

You can use fanart to build up a fanbase without making money off it. I follow a few artists who draw fanart but don't sell it, and whenever they open up commissions for original stuff all of their slots get snapped up right away. And I'm talking commissions that cost $90 or so for their cheapest offering.

They won’t bring down the copyright ban hammer down because some fans have porn drawing patreon accounts.

I pay a fan $5 a month for destiel porn and man, is it worth it!

It's because nobody wants original art. My friends a pro comic book artist, very talented and very popular. Yet all his commissions are for fanart. He offers original and OCs, yet nobody wants it. Luckily a lot of the bigger comic book publishers ignore that when it comes to their artists and he can draw their property freely. But I dread to think what a poor hobby artist has to go through to get any interest if a pro can't do it.
