I'd definitely call it non-con (since that literally means "non-consensual", which seems to apply) but not necessarily rape

Eh, but in order for an act to be non-consensual, there has to be a possibility of consent, no? Things - and a dead body is just a thing, not a person, in the end - aren't in the class of entities that can give consent. There's no mind there, after all.

I suppose the counterargument is that the person, before death could give (or not give) consent via a will or whatever - but upon reflection, I think that that form of consent is a different one entirely from the consent implied in the term "non-consensual". (insert rant about the slippery English language) Consent given via a will would be more along the lines of "this is what I want done with my things after my death" - and these generally aren't the sort of wishes we (as a society) give equal preference to as those of living people. (See organ transplants, for example).

I should really just go read the SEP article on this, and then stop thinking about dead bodies & their wishes.

I don't think so. For example some one living eg: someone with dementia or very severe learning disabilities would be unable to give consent. It would still be considered rape to have sex with them.

They can't consent because even when they do they're have not had the possibility to make an informed decision. On the flip side a corpse can't make any decision at all.

I purposefully left out any references to necrophilia because I have no interest in a pointless discussion about the subject. My only reason for commenting was to say that there doesn't always have to be a possibility of consent in order for an act to be non-consensual.

I suppose it depend on your religious/spiritual belief, but for someone who sees a dead body as nothing more than worm food, the idea of consent doesn't apply to necrophilia. It's like saying that fucking a blow-up doll is non-con because the doll never consented. But the doll is a thing. It can't consent, but it can't not consent either, you know? It's completely unrelated to the idea of consent.

Obviously there's still a huge difference between fucking a blow-up doll and a dead body, but that difference is not consent. The differences is that the dead body has relatives and friends who care about it and would be upset by the necrophilia.

non-con covers a lot more acts than rape does. Rape is non-con, but non-con isn't necessarily rape.

i think they mean that, like... fucking a dildo or a fleshlight is non-con, because a sex toy can't consent. but i don't know if that is a legitimate point of view, because an object is not the same as a living creature.

in a lot of fics, non-con is used to describe a situation in which, say, a character is being forcibly kissed by someone or is receiving unwanted touching/fondling. Those things aren't rape but, like rape, they are a form of sexual assault

Still a dressed-up term for something we already have a word for - it's called molestation people.
