Yeah, I'm in that latter camp, sorry. You're looking for drawn kiddie porn, and are so ~traumatized~ when you stumble upon the real shit? I don't think you're sick, though. Just an idiot.

I hope you had the common sense to report the child porn site you found to the authorities at least. If not, then you're a sick fuck.

I'm gonna disagree on both points.

1. OP saw the anime stuff as a completely different thing, and, in fairness, the japanese drawn stuff can seen pretty abstract and not really "kiddie porn" in the same way yaoi doesn't quite seem like "two men having sex,"but when faced with the actual reality, realized "holy fuck, no!" and now understands why it's messed up? Yeah, that makes sense.

2. Computer technicians that have been fixing other people's computers, found kiddie porn, and reported it, have been prosecuted because technically they "looked at child porn." If you have to report it, create an entirely new email address, using a public computer that can't be traced to you, and never access that account again. Also, clean out your home computer as best you can.

I didn't bookmark the link, but there was a relatively recent ruling in New York to cover cases like this. (You stumbled into the wrong thread at 4chan, viruses downloaded stuff, etc.)

[personal profile] visp 2012-08-24 11:18 pm (UTC)(link)
Well, let's hope you live in New York, then. Still, I wouldn't take the chance.

(Anonymous) 2012-08-24 11:22 pm (UTC)(link)
What I'm saying is that there is now precedent.

If I accidentally see child porn I'm going to report it, and it bothers me that you're trying to scare people into not doing it.

(Anonymous) 2012-08-24 11:26 pm (UTC)(link)
Good lord, this. Don't report illegal shit that's hurting real people or BAD THINGS MIGHT HAPPEN TO YOU kinda makes me side-eye this person a little, ngl.

Except [personal profile] visp said to report it, just to be careful in doing so. So you know, you lose.

"If you have to report it, create an entirely new email address, using a public computer that can't be traced to you, and never access that account again."

That seems terribly impractical and not particularly encouraging of reporting.

Come on, Harry! :(

Precedent in one state in America, and that's just an interpretation of the current statute, which the legislature could decide to change at any time. And just because the circumstances in one case ended up that way, doesn't mean a person couldn't be charged another way. If you recall, I did suggest a safer way to report something, but go ahead and be bothered by the mean lady ruining your righteous idealism with pesky facts.

That's not actually a binding precedent (what you mean by precedent- a ruling that sets a standard for future rulings) outside of New York, any more than a ruling in Canada is a binding precedent in the US. A binding precedent has to be within the same jurisdiction to be anything more than a persuasive precedent (a possible sway to the judge). Only federal rulings can be a binding precedent to all US states.

So, visp is actually being smart. It's much easier to be careful than to try to convince a judge that you were not looking at child pornography on purpose and that a New York ruling should totally apply to your non-New York case.

(Anonymous) 2012-08-24 11:12 pm (UTC)(link)
Did you seriously just equate child porn with gay porn? Because I sure as hell hope not.

You're free to disagree all you like. And I'm free to think you're a little messed up if you think child porn is totally ok as long as it's simulated. Welcome to the internet.

[personal profile] visp 2012-08-24 11:17 pm (UTC)(link)
Gay porn is adults, child porn is children - not in any way the same thing. I meant that weird Japanese animated pornography can be very different from real live stuff. I don't think that kiddie porn is ok so long as it's fake, but I can see how someone would be into the animated stuff and not really associate it with the real stuff until s/he actually saw some real child porn and then realized how fucked up it was.

As someone who likes both BL manga and gay porn, I find this terribly amusing.

"You wish to torture me by projecting these images? WHY YES PLEASE! Can I have some milk and cookies, too?"

Cognitive illusions, for the win?

trying to make sense of this, I have a cold

(Anonymous) 2012-08-25 02:59 am (UTC)(link)
I'm confused by this thread.

If you already saw child porn accidentally on your computer for whatever reason, then it's already in your caché, so going to report it or not going to report it doesn't make any difference on that, does it?

So what is the point of going to a public library to either find the address again to report it, or if you wrote it down when you saw it the first time, just going to report it?

Or does the reporting itself bring down the cops on you?

[personal profile] visp 2012-08-25 03:26 am (UTC)(link)
Depends on who you're reporting it to. If you're reporting it to any actual enforcement authority, then yes, that is going to get you some attention. Clicking 'report' on a forum that only directs to the admin is something else. But doing the latter wouldn't actually do anything to help stop child pornography.

Huh. Okay, then. Thanks for explaining!

Well, part of many US laws on child pornography is the receiving and/or possession of child pornography. To report that you saw it pretty much says that you have received and/or are in possession of child pornography.

Here's a basic rundown of US state laws regarding child pornography:
