Legally no, but morally, copyright law is a joke and I don't care how people make money as long as it's ethical.

Yeah I get really confused when people conflate legality with morality because those aren't the same things. Copyright law isn't even as straightforward as many people think and it gets especially complicated when it concerns art because art through the ages has always been influenced by other people's artwork and stories.

It also has the problem of protecting big companies over small time content creators, essentially anyone with money can buy any content they want to use but people without money are in extreme danger of having their ideas taken and not having the resources to take from others.

This. An artist should be able to get paid for their hard work, so long as they're not being jerks about it.

Now charging commission to cover production costs I can understand.

Yes and no.

I have no problem with artists and writers charging for their time, effort, and services rendered.

If someone is trying to publish a fanfic and sell it for cash in a mass produced, open market, buy a copy kind of way, no.

That's pretty much how I feel about this. Commissions are fine. Trying to publish it by changing character names or whatever is a big no.

I'm fine with republished fanfiction if it's not available for free, and if it can be enjoyed on its own, without the background of a fandom and its rules/universe. This isn't always as easy as it sounds, but I've read lots of stories that were great, and i enjoyed, even though I knew very well they had to have started life as fanfic. (I've only known for 100% certain when I recognised the fandom, though.) Heck, even Rainbow Rowell's work plays pretty heavily with some boy wizard tropes. :)

Considering there are many "legal" ways for big companies to steal content from others (and the fact that many companies have stolen), I don't really have an issue with people making money with fanwork.

I do think you should be attempting to create something original with your fanwork though- draw in a different style, create a product that doesn't exist in the market, basically don't compete with the original work in question.

I honestly believe that the non-profit production of fanwork is part of what keeps the community what it is. I find this problematic with fic especially, since the interaction between writer and reader often can shape that a lot (by sharing headcanons, reviewing ongoing fic, giving inspiration for later works etc) the moment ONE reader can claim some kind of moral ownership of a fic because they paid money for it, these some community norm that are violated.

I think if you have an idea and you want to pay for a writer whose fic you love to polish it and write out all the details, say 3 hours of work for $15/hr or something, more power to you.

When you write on commission or to a request, a lot of the time the basic ideas aren't yours. People pay you to do the work, that is putting words and detail and dialogue, to the fic they already have imagined.

You both then have claim to the fic. Them to the idea, and you the writer to the creative detail and execution. Just like scriptwriters, directors, and producers on a movie share different kinds of ownership.

I think selling an individual piece of work or charging for fanart/fanfic commissions is fine because people are paying for the time and effort you put in to that particular piece. But making prints of something and selling those? No. They aren't your characters to be using as a vehicle for profit.

Under the current system of copyright, fuck no. Axanar demonstrated that the "fair use" argument goes out the window once enough money starts changing hands. Commercialization of the hobby will quickly trigger legal action against hosting sites and networks.

I think they should get money appropriate to the amount of effort/work/art they put into the fanwork. I hate the 'artists' who take official images and run them through quick photoshop filters, print them out and sell them at cons.

Also no bootlegging and trying to pretend it's official.

But if you're putting the time and effort into it then I don't see a problem with being paid for it, especially when you're providing something the main companies can't or won't.

Getting sued or arrested is really rare, mostly what people get is take down notices and the majority of people comply with that.

Legal action is very expensive and even for big companies with a lot of money it's not worth the time unless someone is making a ridiculous amount of profit or competing directly with the company or in some rare cases, if they piss off the company somehow.

That's not to say fan creators who sell shouldn't be wary, but outside of the law and specifically at conventions there's kind of an understanding of what to do and not to do regarding selling fanwork. Most companies generally will not make a fuss about it, especially since many artists under their employ even sell fanart themselves.
