But really, why does is matter if someone who is in a vegetative state can breathe and someone still have sex forced upon them, an why is that any different from someone that is dead and having the same act upon them.

More or less, why does is matter if they can breath or not?

Depends on what you mean by vegetative state. Just because someone can't move or talk doesn't mean they aren't able to sense anything going on around them. Even someone with severe brain damage might still be able to see someone force themselves on them

Also, I don't know about you, but I think living people have a soul that is linked to their consciousness and dead bodies don't, because their consciousness has left the body by that point. Bodies aren't people, but even people in comas or vegetative states are still people.

There isn't really any scientific proof of this, though. If you do a sternum rub on a person their eyes tend to flinch, but that doesn't mean they feel it, it could just be a normal body reaction.

It depends on the culture, some cultures don't believe the soul leaves the body until they are buried, so YMMV there.

Well, childings would call that belief "stupid" and "superstitious" because it differs from her own beliefs re. the nature of the human soul, which are not superstitious at all.

But being that it's relatively difficult to determine technicalities of "whether X person is aware or not," why would you bother taking the chance?

If there is any, even .00001 percent chance that someone can sense what is happening to them, or wake up and have to deal with the consequences, it's rape. End of bloody story. Period. If they're alive and you fuck them without express permission, even if it's unlikely that they'll ever know, it's still fucking rape.

Personally, I do.
I know not everyone does (I just can't believe in an afterlife personally), but how many people who believe in life after death think that a person's soul sticks around in a dead and decaying body after they die? I would think if someone's soul lives on they wouldn't be confined to their body anymore.

Because if they breath, they're still living people and are protected by a bunch of laws. But if they don't breath, they only have the right to be respected and properly buried/burnt/whatever. So fucking a dead body is a disgusting crime, but it's not rape.

Your argument is a little off there. If you are breathing (and technically someone within a vegetative state can be a breathing machine) you are protected by laws but so is someone having sex with your dead body. Both are punishable by law.

And as for it not being rape, well that has to go by your own definition and penetration without consent is mine. SO YMMV.

Well, let's try the argument from a different angle here. A person who is clinically dead/braindead is technically dead, though isn't so legally in most countries. So it matters legally, to begin with.

Secondly, the family might still consider the person alive (there is no such confusion for a corpse)?

Thirdly, intent: the intent of someone having sex with a vegetative patient is not that of a necrophile, as the person is still warm and breathing. So the intent might very well be to rape.

And number 4: Quite important here: There are a lot of different degrees of brain damage and coma. Unless the perpetrator had actual access to a brain scan of the patient,he could in no way know if the patient is braindead, braindamaged, or has a chance of full recovery. So he would not know if he's sticking his dick in a braindead shell or a person with the capacity to recover. Adding to that, again legally it might prove to be difficult to prove which type of state the patient was at the time of the sexual acts.

tl, dr: even if you choose to see a braindead patient as "dead already" - there is a whole lot of reasons that make it different from a corpse.

I'm going at the angle that consent can't be freely given in any case. I understand that some people in this thread think that having sex with a dead body isn't considered rape, but to me there is no difference whether they are breathing or not.

No,but by most of the medical world it would be considered okay to unplug them from the machine that's keeping them alive and then put them in the coffin. Hell, they'd be dead long before anyone could physically put them into the ground. So that is just pointless hypothetical, because it could never actually happen.

There's a huge difference. A corpse is not a person, it's a chunk of flesh & bone, a carcase no different than a cow's. There's no brain activity, no conscious, no vital signs, nothing. Because it's dead.

Alive - a person.
Dead - a corpse.

So to get you back on track, what would be the difference between having a sex with someone who is dead or in an vegetative state? Are they able to give consent to it? Nope. Don't think so.
