I got it from a tweet from Demand Progress, so I assume it's fairly legit. I don't think they'd scare the shit out of everyone if it wasn't verified.

I don't want it to be real, either, believe me, but I thought I'd warn people :/

Maybe this will be regressive enough to end up actually pissing off some congressmen, and getting some well needed IP legislation.

I mean the reason you guys have a do not call list is because Chuck Schumer got called by telemarketers one too many times.

Ffffft, are you kidding me. It's the Congressmen who are supporting this shit. They've got a lot of corporate sponsors to please for when the re-election cycle rolls back around, so they make nice about shielding their profits and disguising it behind lawfulness.

Plus they're afraid of the internet. Remember the "series of tubes" comment? From an old Congressguy who cannot fully wrap his head around the interbutts.

That's... really, really unlikely.

I mean there'd have to be a hell of a lot of public outcry about this for it to happen, because the money is all on the side of incredibly regressive policies, and it's not like there's a principled commitment to a free Internet amongst any members of Congress.

I mean, even if there's some congressperson out there who really loves browsing the Web and downloading shit who gets dinged by this, they're still going to value the campaign contributions over their personal welfare - and this isn't telemarketers, who are fairly marginal and not that wealthy, it's all the content creators and copyright holders. The whole entertainment industry.

Well, see the thing is, they've pretty much already been doing all of this except for the kind of Orwellian "education" part. Lots of the ISP guys already monitor internet usage and purposefully choke internet speeds of people who download stuff.

But I figure that there'll be enough public screaming on the internet now that it's been officially announced that most likely there will be some more scrutiny of the ISPs' practices. Hopefully.

I assumed the choking due to downloading was simply to discourage people from taking up so much bandwidth. Now it seems like they're going to actually monitor what's being downloaded? However well that's going to work... But it still leaves a lot of questions: will they monitor streaming? Can they look into torrented .zip files to make sure it's not a movie/music album? Do they care about foreign media that's not available in the US? Can they follow a download through proxies? What about people who use public WiFi hotspots?

I'm baffled as to how they think this is going to work, but I'm also scared that they're going to err on the side of false positives, which will screw "legitimate" customers over, too.

Hopefully this will crash and burn and they'll pull it, but it's still raising my hackles.

No, they do not care about "foreign media that's not available in the U.S." Because that's just tough noogies for us that not everything is available to our greedy little American hands.

(nayrt) If it is, there are going to be a lot of angry customers - TPB and other torrent sites also host things that are actually legal to download. (I know it's mostly pirated stuff, but that's not the entirety of what's being downloaded from there.)

Probably not. This is already a very very gray area, so they probably won't get so draconian as to permaban you for just visiting a torrenting site. For all they know, you could be doing it for research, or just got accidentally rerouted there.

Most US law enforcement/legal customs come down on the side of behavior-- as long as you're not out and out doing something, they can't punish you. So, just visiting rather than downloading is unlikely to get you "re-educated".

But you will probably get put on a watch list. Just sayin'.

It is. It's affecting AT&T, Comcast, Verizon, and Time Warner, it looks like. Possibly others.

I have Comcast right now, and it's hella expensive. I might look into one of those three if they're available here. Thanks for the info!

Arrgh. I want to begin playing Perfect World International again, and the best way to download the game is via a torrent, one supported by the company.

However with all these new laws, I'm nervous to even attempt to download the game in that way.

And I don't even live in the US. o_O

If your ISP isn't one of the ones listed, you're fine. I looked more into it and it looks like the ISPs can't even really do a whole lot aside from nag you about doing Things They Don't Like. Once torrent download likely isn't going to ring any bells, especially if it's not one that the original company is going to complain over you downloading.

I'm confused about what this actually does. The comments on the liked page suggests it will mostly go after torrenting and that it would be easy get around. If that's true, I'm not terribly scared, because I've never torrented anything and could find people to teach me the work-around if I did.

If it were strict enough to actually affect things like YouTube, Facebook, wikipedia, et al., and people could be punished for unknowingly accessing, say, copyrighted photos posted without permission that you didn't even know were there because you haven't scrolled down that far yet... that's scary, but it's not clear that is what will happen.
