Well, couldn't society/the court/whoever sentence the Joker to death and then give a kill order for him or something, or nominate Batman/Superman as the executioner? Or, on one of those times when they manage to drag the Joker to prison (because it does keep happening) they take him to be executed and just have Batman/Superman standing guard to make sure it all goes smoothly.

It seems to me like if society at large is really insistent on having the Joker six feet under this should be quite possible to achieve.

Last time the Joker was sentenced to death, Batman got him off on a technicality (the technicality being that technically he hadn't committed *that* murder). There is also the thorny problem that, in the DC-verse (or at least the oldDCU, nuDCU is still up for grabs) that even hell might just be another cardboard prison for the Joker and he'd be back in the mortal realm within a few days and now with super-demon powers.

See, Batman getting him off there would piss me off like crazy.

The hell thing is not actually Batman's fault but yeah, might contribute to why I'm not enamored with Batman these days... that stuff just frustrates me, so many crazy plot-gymnastics just to keep the Joker alive. //sigh

Well see, that actually made sense though.

Batman couldn't abide the actual murderer getting away. Of course, catching the criminal meant exonerating the Joker.

It's really every other part of the Gotham Justice system that's failled, since there were so many other murders they could have tried him for save that one.

I mean seriously, how has a politican not run on a "lets get the death penalty in Gotham" platform? Hell, how has every politician not?

Yeah, you'd think by now they have enough crimes on him that once they've got him in one place for half an hour they could convict. I mean where the fuck is the jury who would NOT convict the Joker???

You sit there in the Jury box thinking "I'm going to convict this sob" and then just as the District Attorney starts talking about the people killed during the Joker's last escape, the Joker turns to the Jury and gives you a little wave. Suddenly, reasonable doubt starts creeping in, and also the overwhelming urge to urinate too. Yeah, if I was on a Gotham jury, I would never find any of those freaks guilty (and would look into moving out of state too).

I think it is because the Joker's girlfriend is on that team (Harley is on the suicide-whatever team, right?). The DC verse is run by assholes even in-universe.

I'm guessing through either being bribed/blackmailed/intimidated out of it by the criminals in question, or if not accepting of bribes, then killed by them.

Can you imagine the campaign press-launch?

Reporter: So Mister Smith you are running on a zero-tolerance policy for criminals in Gotham and closure of Arkam?

Mr Smith: Yes, I ah-hahhahahahahahahahahaHAHAHAHAHAH! [slumps forward with huge smile on his face and an umbrella in his back].

To be fair to Batman, if the Joker got executed for a murder that someone else committed then it means the real killer got away with it, and that is not a good thing at all. Even if Batman waited until after the execution to reveal that "oops, executed the wrong guy oh well it was only the Joker" it still increases the chances of the right murderer getting off because their slimy defence attorney (and is there any other kind in Gotham?) could parlay that into reasonable doubt on the old "well we laready executed one wrong guy, do you the jury want to take the chance of making it two?". Which has happened in the real world, juries don't like convicting on cases where one person has already been wrongly convicted on even if the evidence is impressive against the new guy. One of the problems with the DP is that you have to execute the right person each and every time to keep faith in the system.
