Jury Duty Advice

(Anonymous) 2015-01-21 01:57 am (UTC)(link)
I have jury duty coming up (I can call in the night before to see if it's been canceled) and I'm already panicking about getting chosen to be on the jury. I've done this shit before and it was a massive waste of time (we had one person on the jury who wanted to play "12 Angry Men" but the guy on trial was so obviously guilty, it was ridiculous to be deliberating at all; it was a case involving kidnapping an older man and stealing his wallet, if you were wondering).

My state has BS rules about jury duty (can't use the excuse of work or school) and I really need to focus on my college coursework this semester. Do you guys (and gals) have any ideas for ways I can get out of it? I've already been losing sleep thinking about the backlog of homework this will create.

If they ask you if you'd give more weight to a police officer's testimony than a civilian's, say you would. My dad's gotten out of jury duty twice for that one.

Make a bunch of super racist comments.

At the end of every sentence say "as is foretold by the prophecy".

Insert as many internet memes into the conversation as possible.

Answer questions with, "I know you are but what am I?"

If you show really strong opinions one way or the other on a question, one or other side is likely not going to want you.

That being said, I'm weird in that I love jury duty. I've only been on a jury once, and the case settled, and I'd love to be on a jury again.

What I've heard: play the racist (although this would make me cringe)

I've heard trying to act very incisive and analytical will also work but this seems like it could backfire too. The person who told me this said they want "stupid" people on juries but I'm not sure how accurate that is.

they absolutely do want dumb people on jury duty, or it'd be more accurate to say they don't want smart people. they kicked off every person who'd been to law school when I went (about 3 people), even those people who said aloud they were committed to unbiased decision-making. they were a little -too- educated for their tastes.

No, that makes sense to me. Juries aren't supposed to decide questions of law. They're supposed to take the judge's word regarding what the law says and follow his instructions, and if there's a reasonable chance that they can't do that, they probably should be removed.

And moreover I think that system actually kinda makes sense? IDK

I have to disagree about BS stuff - I've heard of people having to face prison time because the judge caught onto the BS.

If you have a strong opinion about something that would impact the case, say it. Hell, my mom got out of jury duty because she said her faith in the plane being flown is directly related to the faith she has in the pilot operating the vehicle. (It was a thing about whether the pilot or the manufacturer was at fault for an accident in a little two-seater.)

If you have ANY strong opinions, share them. Each lawyer wants someone they can mold and shape to fit their ideas. Show them you won't be swayed, and see who wants to get rid of you faster.

From my experience getting called for jury duty, say that you have an intellectual or moral conflict with their instructions that you don't believe you could resolve, and they'll let you off, as long as you seem even remotely sincere.

Maybe that won't work in your state, I don't know! But I wouldn't sweat it too much. Hey, who knows, maybe they won't even call you!

Take your homework with you to the courthouse. Mostly it's just sitting around waiting anyway.

Since everybody else has given advice on getting out of jury duty, I'll give some advice for if you can't: I am fairly sure most states require colleges to give students time off/extensions on all assignments for jury duty purposes. Talk to your professors and see what accommodations they can make for you, and then talk to your Dean of Student Life or whatever (and if you're having problems with any of them, talk to student government since that's pretty much what they're there for.)

To tell you the truth, my father has gotten out of jury duty by taking his bible with him and reading it openly. Usually one of the lawyers will object to his being selected during the voir dire but the last time he was called (several years ago), the judge refused him after the lawyers accepted him.

Of course, my father is a very religious fundamentalist Christian and extremely opinionated. I'm sure that has played no small part in his rejection by the judicial system. :)

If you can reschedule, try very hard to get a week that has a Federal Holiday in it. The week between Christmas and New Year's is best; they let you out super early because no one really wants to work that week even if they're supposed to.

Maybe reschedule to around the time of Spring Break? The jury pool will be so glutted with people trying to squeeze in Jury Duty during vacation that you might never be called in at all.

-Be "overeducated"
-Study psychology/law

They don't want people who actually can form educated opinions. This is a fact.

think back to any history you or someone you know has had with the legal system and see if you can relate it toward the case.

for example, last time I got close to having to serve on a jury, I told them completely honestly that my impression of someone who owns a gun is negatively impacted by my uncle who owns a gun and who has regularly abused other family members with threats and other shit. if you are related to someone who is in law enforcement, make sure you air that loud and clear too, the defense will want you off the jury.

make your association and explanation believable without pushing it too much. I remember this woman next to me was so obvious about trying to worm her way out of jury duty with, "I just don't know if I can be UNBIASED~~ *eyes the defendant's lawyer*" bullshit that no one actually bought her act.

but that's my advice, search your past for any interaction with law enforcement, good or bad, or criminal acts in your family's past that may have shaped your views of how criminals are or aren't punished enough.
