yes. infact I believe most rapes committed against women are done not out of spite, but out of blunt and irresponsible men not giving a fuck.

i don't believe that excuses shit, however. if you accidentally run someone over because you didn't care that you were drunk when you got behind the wheel, you're still a fucking murderer. if you rape someone because you didn't care to check that she was comfortable with what you were doing you're still a fucking rapist.

you're both drunk, but you're just dumb drunk and she's black out drunk. you get consent, but she's too drunk for the consent to be meaningful and you're too drunk to tell the difference. She's incapacitated and you are not. that is accidental rape.

I think in the scenario you're outlining both people would have to be considered too drunk to consent and it's hard for me to consider such a scenario rape.

What if the consent is conditional and you find yourself unable to meet those conditions after the fact through no fault of your own? I'm thinking of sleeping with a prostitute and then finding you don't have enough money after the deed has been done. Her consent was conditional on being paid by you, you are unable to pay, consent is then withdrawn and you've raped?

Or other conditional consent (I know somone people here don't thing raping a prostitute counts as rape unless force is used) Say you're in a relationship, and the consent is dependant on the continued relationship, but you are for whatever reason unable or unwilling to continue that relationship. Consent has been withdrawn and it becomes rape.

The Girl Who Cried Wolf and Law and Disorder - Guy A roofied a girl and Guy B (an ex of the girl) went home with her. Guy B did not know about the drugging and had sex with her. She says she was raped and Guy B says it was consensual sex. She was raped, but technically by Guy A with Guy B as an instrument of rape, I think.

I would say that guy A raped both the woman and guy B. Both have reason to feel violated by guy A's actions.

How can you not fucking tell someone's been roofied? Her condition alone as being so fucking out of it should have made Guy B stop. So both Guy A and B are rapists.

I think you can rape without the intention, but then again, those have to be very specific circumstances and it makes me uncomfortable how often we have speculated about them.

Yeah, it is like too many guys are actively searching for loopholes. If they really want to find a loophole that bad, then they know they just want to rape. Its just a cover to try and legitimize their desires and rapefaces. What is so hard about getting clear consent and saying no to yourself if you have even the merest scintilla of doubt?

It is like the guys who say how are they supposed to know if a girl is underage? If they have to ask, then she is underage and move along the bar until you see someone noticeably older/

Yes, it's possible to not ~intentionally rape/not check consent, but but most often within a framework of entitlement, beliefs about the sexual imperative, irresponsibility and independence from what the other person wants when getting off. Whether blind drunk or not.

Guy wants to have sex with his gf/wife. She says no, she isn't in the mood, but he puts his dick inside her. She doesn't want to but it's her bf/husband, she isn't going to attack him to make him stop so she just deals with it. She has been raped, he doesn't even consider what he did as rape. Perhaps not even her thinks of it as rape

Failure to get affirmative consent doesn't make it unintentional. It's intentional rape in that case.

Yeah, and a big part of the thing about "rape" is that although we, including men, know that rape is Bad Bad Bad, so much that *is* rape is called other things. So in the end, only Stranger Danger done by perverted evil bad other men is rape, and everything else is just, to quote a judge once, "rougher than usual handling". Still doesn't mean that men aren't being taught on a number of cultural fronts that what women want in the bedroom isn't all that important when getting your rocks off, and that these men shouldn't be held complicit for it. Decent guys who respect women can generally figure this shit out these days.

It's never an excuse, however. One party not understanding that they're violating the other doesn't absolve them of responsibility for that violation.
