(frozen comment) So, this happened at my Apartment. Need advice.

[personal profile] otakugal15 2013-07-26 11:10 pm (UTC)(link)
Ok. Last week, I was taking a bath and as I was getting out, I slipped a bit and grabbed the handle that’s on the soap dish, cause, you know, that’s what the HANDLE IS FOR (maintenance guy tried to tell me it wasn’t. bullshit), to steady/catch myself so I didn’t get hurt, and guess what happened?

The soap dish, plus 4 tiles came off the wall. It came of easy and the tiles came off smoothly.

I got to looking at the damage and the wall was wet underneath, there was hardly any adhesive on the tiles and soap dish and the rest of the wall was kind of bowed due to only holding on by the caulking between the tiles.

WE had no idea that our wall was that damaged. Sure, there’s little cracks in the caulk, like you’d find in any bathroom and we really should have said something about that in the beginning, but it wasn’t really a worry. THAT is our fault.

What is NOT our fault is that maintenance, when working over a FEW WEEKS, to get our apartment ready for us, didn’t bother to check the walls in the bathroom for any issues and the like.

We’re BOTH at fault for that.

So, they are gonna try and charge us for the damage they’ll have to fix which can cost anywhere between $200-$1000.

What. The. Fuck.

It was a simple accident cause I didn’t want to get hurt, YOU didn’t bother making sure the apartment was livable before we even moved in, and now WE will most likely have to eat the cost?

Fuck you.

I thought this place was ok, But maintenance has been slow to respond and now we’re finding out the apartment is slowly falling apart, which will be placed on us. I mean hell even had we said anything about the small cracks in the caulking on the bathroom wall, all they’d have done was fill it in and be done. And we’d STILL be in this situation cause we have no idea how LONG that wall could have been damaged underneath.

Fuck this place.

Is there, like, a tenants union or anything like that in your area? Some place that provides resources for dealing with shit like this / helping you contest it if need be?

good luck! That fucking sucks and it sounds like they're being assholes about it.

I thought the "handle" was actually for a hand towel and not an actual handle.

It is.

Wait, I'm confused. It's a handle that you can grab on to or it's not a handle you can grab on to but is instead only for hand towels.

It's too thick to he a hand towel rack and you usually have one those in the side of the shower to begin with.

It's a handle.

Uh, that handle is for the washcloth, not for catching yourself when you're falling, hauling yourself up or any other uses you dream up. And do you really expect people to tear into the walls? Not even home inspectors do that when you're BUYING a house.

So, sorry you're upset, probably out a chunk of change, and stuck with slow maintenance/management people, but them's the breaks, sometimes.

[personal profile] otakugal15 2013-07-26 11:34 pm (UTC)(link)
It's the fact they took weeks to prepare the place after the previous tenants left. That's why I'm fuming a bit that they didn't think to do a better job of looking over the bathroom. Hell, they left a loose and broken stove handle when we came in and we had to get them to replace it.

It's not a handle, it's a hand towel rack. That being said, it shouldn't have come off the wall like that and your building is not doing right by you in treating you this way.

I have never comfortably placed a hand towel or rag there. I've always used those things as a way to help steady myself if I need to, so I'm confused as to where this hand towel thing is coming from. Especially when you have one on the wall else where.

Just because you use it as a handle doesn't mean it's not meant for a hand towel.

You want a bar to grab hold of in the shower? That's what these are for.

[identity profile] galerian-ash.livejournal.com 2013-07-26 11:25 pm (UTC)(link)
Speaking as someone who used to work with apartment maintenance/repairs, this post really irked me.

You really think that a soap dish -- something that's usually fastened with a couple of screws -- should be able to hold up to a person's full weight (especially if you wrenched it all violently, like people do when falling)? And you actually blame it on the caretakes/janitors because they didn't inspect it to make sure the soap dish was super-sturdy before you moved in?

I don't know how the tiles were fastened or how your wall looks like, so I don't want to make any comments on that. But frankly? Judging from this post and your overall tone, you're the kind of customer that everyone hates. So no, I really doubt you're gonna get away with paying. Had you been decent about it, chances are they could've fixed it for free. I did that fairly often, and so did my co-workers. But when people act like you apparently do? NO WAY IN HELL.

(frozen comment) Re: So, this happened at my Apartment. Need advice.

(Anonymous) 2013-07-26 11:30 pm (UTC)(link)
Ditto. I hate when people treat everything that goes wrong as if they have personally BEEN WRONGED by someone and now someone must PAY.

Yeah, me too. Especially when the people they take it out on are underpaid and overworked -- i.e. the maintenance workers.

(frozen comment) Re: So, this happened at my Apartment. Need advice.

[personal profile] otakugal15 2013-07-26 11:30 pm (UTC)(link)
There were no screws. It was adhered to the wall and as I said, I slipped and caught myself on it.

And the screws argument doesn't hold when you stop to think that people usually get BARS screwed to the wall for the very same reason: to help themselves up or have to catch themselves. That's no excuse for the wall trying to come down because they don't give a shit about making sure the thing is stable.

And just so you know? My boyfriend and I were really civil to the office and the maintenance guy, so don't go judging the situation on a very angry post on the internet.

The handle thing I can see making a case for being the responsibility of the thing, not so much the wall itself.

Are you in the UK? Cause that's pretty common there, I've heard so many similar real life horror stories it's not even funny.

Seeing as you're both at fault, you should only have to pay half. Get in touch with a lawyer if you can.

That's not a handle and not meant to hold weight. They're usually just adhered to the wall with some kind of glue thing (can't think of the specific word atm). It's not the maintenance's fault that you grabbed this in your fall and it broke.

I understand that you grabbed it in an emergency type situation, but still those are not meant to be used with so much weight and I'm not at all surprised it broke.

However the pricing your apt gave you for fixing it is a little ridiculous.

[personal profile] otakugal15 2013-07-26 11:53 pm (UTC)(link)
Look, We have no problem with the soap dish and 4 tile that came off the wall. We can pay for that. What we have an issue with and they're trying to foist on us is the repair bill for the entire wall. The wall that is decaying underneath, that we had no foreknowledge of. And the slow response of our maintenance guys, who are usually very punctual (for small stuff apparently).

(frozen comment) Re: So, this happened at my Apartment. Need advice.

(Anonymous) 2013-07-27 12:13 am (UTC)(link)
Well...depending on how you interacted with them, it's possible because they just don't want to have to deal with you? It's not cool in any case, but that might be part of the reason for slow service.

That said, it sounds like something that's sadly pretty standard as far as paying for the wall goes.

(frozen comment) Re: So, this happened at my Apartment. Need advice.

(Anonymous) 2013-07-27 12:09 am (UTC)(link)
I'm not sure how things are in your country, but in mine it's pretty common for the contract to include details about the state of the place.

If you signed it and according to the contract everything was fine?
You have to paid for it, not matter how much you say you "didn't notice" and that it was a hidden issue.

It's not fair, but that how thing are.

There's a chance of arguing about structural damage that can't be noticed by just looking, but since you say there were little cracks and you didn't say anything...

[personal profile] otakugal15 2013-07-27 12:17 am (UTC)(link)
That's because those little cracks are a common thing that most people don't worry about. And it's something we can fix, which the apartment management says we can do. It's one the few places here that lets you paint and mount things so long as we spackle and repaint the walls before we leave.
