Except that they ARE! One of them owns the person they're having sex with - he can't consent freely because of the extreme amounts of power she has over him - and the other hold the other person *heart* which means that any consent he appears to give cannot be assumed to given freely.

Yeah, I don't watch the shows, so I'm not aware, but my first reaction was basically, "Well. Did they have sex with somebody without their consent? Because that's rape. And that would make one a rapist."

Whether or not the men could consent is a matter of debate; there was magic involved with Regina but Graham still slept with her willingly, and Crixus was a slave but Lucretia left him alone when he asked her to.

Pretty much, this. I only know OUAT, but Regina definitely raped Graham. It wasn't stereotypical or violent, but it was sex under coercion, and in a situation where I don't think it's really possible for Graham to consent.
