Here is what you do if you want to sell your fic. Replace Dean's name with Robert and Castiel's name with Joey. BAM! Original fiction you can sell (and that will maybe become a series that middle aged housewives love).

Fanart is just one single piece of art, whereas fanfiction is a long bit of fiction using copyrighted characters.

Okay, but the problem is that no one is going to buy fanfiction, while many people are willing to buy fanart. I'm not saying it's fair, but fanart is just more sellable. You can turn it into posters and buttons and keychains. You just can't do that with fanfiction.

I don't think people are legally permitted to sell fanart, either. I doubt it falls under fair use or anything - it's more a matter if the company that owns the work actually cares. I know in Japan, doujinshi and stuff are also not technically legal, but most companies see it as great publicity and a way to get more attention to the work (which I respect!).

That being said, I think there's a difference between selling a fanfic and selling a physical fanart. With fanart, the "cost" can be technically to cover materials - paper, markers, ink, etc. - and not the actual image itself. I think that's fair. There's no cost in distributing fanfiction (or fanart) online. If you were to hypothetically print your fanfic, put a cover on it, bind it, and so on and then try to sell it at a convention, that would be a little more comparable. I'm not sure why people would buy a fanfic they haven't read, as opposed to fanart they can see instantly that they like, but whatever.

yeah maybe, but buying fanfiction seems like such a waste of money. you can't hang it on your bedroom walls, for one.

Different mediums have different legal statuses and different expectations. They're not perfectly equivalent.

I was just thinking about this and I am still forever confused about how fanartists get away with selling their art. I just found a whole website/store dedicated to selling all sorts of shit (phone cases, totes, shirts, mugs, etc) with various fanart on it and I just don't understand it. Pretty sure it's illegal, and I don't get how people are okay with it.

They are different mediums after all and I think, often times, if there's no direct competition, fanart is kind of seen as a form of unofficial advertising, while selling fanfic would be seen as profiting from someone else's creation (which, yes, they both are).

I think it's because, with fanart, there's the expectation that the artist will have to buy tools for it, and thus the payment is merely to repay them for spending their money in the first place, on tools, on paper, on a art program, on printing it, etc.

On the other hand, with fanfic, there's the expectation/belief that it takes a lot less; at the very least it can be done with a pack of pencils and a cheap notebook; far less "tools" are needed. Even if its typed, it's still totally possible to do it for "free" or close to, depending on if there's a library where you live that offers computer usage, thus people are mostly paying you for your time, but your "time" is being spent on other people's characters.

Do I think this is fair? Not really. To be perfectly honest, I'd love to be a good enough writer that I could take fanfic commissions, since I can't really draw. |D Maybe I'll be able to make fandom-themed jewelry, and sell that someday. |D

Fanart is not seen as nearly a big of a threat to IPs at written work. Fanart is usually just a single image of a character that's usually in the spirit of canon to appeal to the widest amount of people.

The rule of thumb as far as comic cons go is your stuff shouldn't be mass produced. A few prints, some original pieces, commissions. If you see people doing more online or whatever. Report them. Don't be like "Oh well they're doing it so I can do." No. Report them.

Fanfiction would have to be mass produced because you're probably not going to hammer out a fic for a person waiting in line. There's also the potential, depending on what the fic is for, that the original creators are worried about lawsuits if the idea ends up in the official works. At least that's why mainstream comic companies don't take script submissions.


As someone else said. Change it up and make it original.

Technically, the rules are the same. You are not legally allowed to sell your fanart. It's just most companies, authors and creators turn a blind eye to the smaller fanartists. For the most part. Some companies will sic their lawyer dogs at you if you try to make a penny off of any fan related. Like Disney. Disney is the worst or best, if you see it their way, at going after fanartists.

If you want to make money off your work, change the names and rewrite it into original fiction.

Putting aside the legal issues, in my experience selling fanfic damages the community aspect of fandom and accelerates a fandom's decline. I've never seen really good writers do it - it seems to be mostly mediocre smut writers who let their BNF status and high hit counts go to their head. I think Tiger and Bunny would be a much livelier fandom today if Galiko and their circle hadn't decided it was their personal golden goose.

Thank you for reminding me to resend my email to the What Pumpkin people asking about their legal opinion on commissioned fanfic. I sent it back in January and haven't gotten a response yet, so I'll try again.

I would really hate it if people started selling fanfic. I don't really care about fanart and the legal issues are kind of iffy for me, so I hope this kind of thing never comes up with fanfic.

On a fanart you can put a watermark on it and brag about it. You wouldn't post other's fic on your blog, thiugh.

There IS a stigma in many fandoms about fic writers charging, however, you CAN. In fact, I and about half a dozen other writers I know DO successfully offer commission writing. I'm in the rough drafting phase of my 8th commission, and I haven't been at this an entire 6 months yet.

If you want to take writing commissions, get yourself a Terms of Service and price list together, and put yourself out there. Will you get rich? Probably not, but the real question to ask yourself is in your fandoms do the copyright owners REALLY care? In mine, I'm fairly sure they don't as comics and art of all kinds are made and sold at conventions, and one of the main writers in the canon comics was a fanfic writer himself. My legal risk is minimal, and my financial gain thus far wouldn't even pay two months of electric bills, but it does support my yarn habit. ^_^

If you want to offer commissions, then go for it. People might complain or fuss, but hey, they don't have to pay you if they don't want to. Someone out there will though. Don't let naysayers hold you back from something you want to give a try.

I'm very upset and pretty disgusted that, of the comments in this thread regarding the comparison of fanart vs fanfic and monetizing it, no one has considered the amount of time and research that goes into writing a fanfic. I'm not an artist, but I can guarantee you that I've spent more time researching and writing some fic than artists have spent drawing and coloring many of their creations.

I don't believe that either should be sold for money, but I cannot believe some of the posts that have been made in this thread.

Fandom is hardcore about that, yeah. I know I got super pissed when a tie in novel series took a non-canon ship and made it canon in the series so I guess I'm pretty sensitive about it, too. Fic with the "serial numbers filed off" - that I'm fine with.
